Agreement
These Terms of Service (“Terms”) govern your access to and use of Upsellyfy’s website and Shopify apps (the “Services”). By using the Services, you agree to these Terms. This is a template—review with legal counsel for your business.
Eligibility
You must have authority to bind the store or business to these Terms.
Using the Services
- You will follow Shopify’s policies and applicable laws.
- You are responsible for your store content, products, pricing, and promotions.
- You will not misuse the Services (security testing, abuse, or unlawful use).
Billing & Subscriptions
If the app is paid, billing is typically handled through Shopify (unless otherwise stated). Fees, trial periods, and plan limits are described on the pricing page and/or Shopify listing.
App Permissions
The Services may require access to certain Shopify store data based on permissions you approve. We use this data to provide app functionality and improve the Services. See the Privacy Policy for details.
Intellectual Property
We own the Services and related intellectual property (excluding your store content). You get a limited, non-exclusive, non-transferable right to use the Services while your subscription is active.
Third-Party Services
The Services may integrate with Shopify and other third-party tools. We are not responsible for third-party services, outages, or changes to their platforms.
Disclaimer
The Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, or specific revenue outcomes. You are responsible for verifying discounts, bundles, and storefront behavior before going live.
Limitation of Liability
To the maximum extent permitted by law, Upsellyfy is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.
Indemnification
You agree to indemnify and hold Upsellyfy harmless from claims arising from your use of the Services, your store content, or your violation of these Terms or applicable laws.
Termination
You may stop using the Services at any time and uninstall the app. We may suspend or terminate access if required for security, compliance, or misuse. Certain sections survive termination (e.g., IP, disclaimers, limitation of liability).
Changes to Terms
We may update these Terms. If changes are material, we will provide reasonable notice. Continued use after changes means you accept the updated Terms.
